First off, I KNOW WHAT I WAS DOING, AND I DON'T NEED ANY OF YOUR RANTS.

Alright, with that out of the way, I was following a truck up the hill, and I look up the hill aways and there's a bunch of state cops sitting out side there cars. I look right at my spedo right away, and i'm doing exactly 39 (i usually never go over 40). The state cop pulls out to follow me, I pull into the parking lot of the highschool and park. Here's where it gets interesting, when I get out of my car, acting like I never saw him, he was already walking to my door. He said I was speeding and he needed my driver's licence. So I gave it to him naturally, and he came back with a ticket. He said I was doing 41 in a 30. This is where I said "out of courtesy officer, may I see my speed on the speed radar." HE REPLIED, I DON'T HAVE IT. I then asked "how can you give me a ticket if you don't have my speed on the radar gun?" He said "he knew i was going 41" Walked back to his car, and got on in. So, what can my lawyer do about this, and was there a problem here with this cop?

i've heard from a few friends that a cop must be able to show you your speed when he pulls you over, but then I have read online that that isn't true.... so i'm not sure if you can fight that or not...

sorry man... tickets are no fun frown.gif

First, you dont need to hire a lawyer for a speeding ticket unless your going to get your license revoked, its not worth it. Second, he has no evidence, therefore you plead not guilty, and go to court and since theres no read out, he has no evidence to back himself, so most likely you will have it reduced to a non-moving violation.

No thats untrue. They do not have to show you anything, but you can fight any ticket.

the only time I faught a ticket was when he claimed i was doing 51 in a 35 when i was actually in a 45.. biggrin.gif

they reduced it to improper equipment... so i still had to pay, but no points!

well in my case, i would have had to stay the rest of the day in court... plus i wasn't sure if the evidence i had would have won over the judge... i was afraid that if I fought it and lost, i'd have to pay and get points on my license... this why I didn't have to get points.

I had pictures and all.. but i was afraid the police officer could have said he clocked me later which put me in a 35.. i was happy to get off with Improp Equip

It would probably be better to just take the punishment then to fight.

Absolutely not. You have nothing to lose by fighting a ticket. It is expected that you plead not guilty. Just pleading guilty and taking what you get is completely the wrong thing to do.

I'm not talking about loud exhaust tickets or that. Speeding tickets, moving violations, things that you have complete control over, you dont just take the punishment, you plea bargain.

check your ticket for a wierd number with letters, which is the code for the radar gun, if there is no code then you win the fight... cops cant win speeding tickets without the proof to back it up.

That is not really true you can get a ticket with out a radar gun. In this case the cop has to pace your speed a distance behind you but the catch is, he has to do this within a two mile zone. If you are speeding and he has paced your speed for the two miles you can get a ticket . But if he has not paced you for the 2 miles he has nothing to stand on. How do I know this you ask....I have been pulled over 3 times for speeding and every time i have taken the cop to court and won. Around here we have arrogant cops that will pull you over just because you are a kid and have a fixed up car. I hve been pulled over for tint. for my body kit(soposidly it's illegal to have a body kit on your car around here), and for having my high school tassle hanging from my rear view mirror. Anyhow back to the topic...I would most definitly take this to the judge...the cop has nothing to stand on also....one question did the cop turn on his lights when he pulled you overor came up to you in the parking lot? If not make it clear to the judge that he didn't show any sign of pulling you over untill he walked up to you and asked for your liscence.

okay...sorry about the spelling it's 2 am so give me some credit...

First things first:
Your speedometer is never 100 percent accurate. You could of well been doing 41.
Second:
Cops DO NOT have to show you radar. This is a super wild spread rumor and it should die as it is making people sound like asses.
Third:
Always fight. You see the judge and deal with the DA. Sometimes the cop MIGHT be there. Its not like your standing in front of the whole station. 9 out of 10 times the DA will throw out either points or price if you have a clean record. Oh, never piss off the DA either. You get to see his or her smiling face with every ticket.

I just emailed the prez of my car club. He's been a state trooper for 13 years. He'll once and for all explain the "radar rules". odds are it'll be a text book answer along with a loop hole answer...... that or a yes or no answer. Could go either way.

you all have to keep in mind when posting that every state has dif laws dif cops and dif reactions. On a norm time i drive 10-15 over, just because thats how most drive. I have had cops come up behind me when im doing 75-80 on a 55 and just look at me then keep going. Thats norm for me in md atleast in annapolis.

Also all cops will give you dif reasons or "rules" or laws.

Best thing is go to court. You might get off with nothing, or you might get one point an a small fine.

I have been pulled maybe 10 times, most was in my old car dodge daytona with stripes. cops loved that thing

out of all those times I got one ticket, because i knew i was speeding but didnt know how fast. My speedo didnt work, but i knew i was doing around 90 or so in a 55, he wrote 84 in 55, i got off with one point an a $200 fine.

I'm an upstanding citizen and I've only been in trouble with the law over speeding tickets. I just hate cops and their attitude. Screw cops, I hope they all get testicualer cancer.

that normally has nothing to do with it. it's just the fact the cops are a*ses and like picking on kids with nice cars. they have nothing to stand behind them when they pull u over and then they don't expect most kids to take them to court they figure most of us just pay the ticket and go. so when someone does stand up against the cop he's screwed

Funny that this topic came up. I just got A speeding ticket about a week ago. This is my first ticket so i was scared and I didnt say anything to the cop. I was going no more than 40 in a 30. It was on a main road right by my house. The cop was comming down in the opposite lane. I see him and I immediately slow down. I dont think anything of it and I slow down. Normally I go 50 down this street and cops pass by and dont care. The cop stops me and asks me for my licence, rights me a ticket for going 51 in a 30, and tells me to go. I come to my senses a second after he gives me the ticket and go looking for the cop. I live in a small suburb right next to chicago so i had a good idea where the cop was going to hide next. I tell him that i wasnt goign over 40, he says it does not matter and that i was still speeding. I ask him for a radar reading and he says that he deleted it. I think it was imposible for him to have had the radar on becuase the look on his face when i asked him, and becuase he was moving in the opposite direction and he acnowledged that i was going under what he wrote on the ticket. After 2 minutes of arguing he told me to plead not guilty, and that he would let me go with a small fine and supervision because it was my first time. Can i fight this, what can i do?
Thanks

don't tell the judge what the cop siad he found out that you wheren't going to let it go and now he's trying to cover his but. he wants you to tell him that, but you need to tell him that the cop had no reading and just gave you a ticket for going a speed that you wern't going and then he told u to plead not guilty and the cop would only give u a small fine.....screw that, tell the judge the truth (what u just told us). The cop is only trying to save himself from his own screw up......I would most definitly take it to court.

you can get clocked going in the opposite direction and sometimes if you go to court and lose its worse than if you woulda just plead guilty in the first place. only fight if you absolutely know you are right

Absolutely not. It will RARELY turn out to be worse, almost IMPOSSIBLE

in fact, usually the prosecuter will offer you a plea bargain before your case gets heard, just to get it out of the way. Jay would know more tho.

always always always fight the ticket!

For the record on this radar thing, the law is different in every state. While I lived in Maryland, I actually went to court and told the judge he did not show me the radar gun when asked. The JUDGE told me that I would be free to go if I lived in Wisconsin or some other states that I can't remember. So go to the libarary and check out the law for your state.

Always fight the ticket, plead innocent. Sure it's scary at first, but kinda fun after you do it a couple times. Go to the library and ask for their books on fighting traffic tickets. They should have several.

Cop pulled me and my brother over in a rented Minivan on our way to our grandmother's funeral a week ago. Since we were out of state, he made us either pay him the cash on the side of the road (85$) or he would take our license (which we need to get back on the plane). Now THAT is messed up. (lol, my brother was driving though)
