Well a new wonderful update on my sister's accident in my car. State Farm being the bastages they are have been dragging their feet through this entire accident. Since the old lady who hit my sister also has State Farm, it has been a friggin month and they haven't said jack and today I get a phone call from them telling me that the accident is 50% my sisters fault and I have to pay a 250 dollar deductable. I strongly believe that State Farm is screwing me over because the people handling the case are from the same office and when I called my insurance agent, she said that I cannot get an arbitration against State Farm when it is State Farm vs. State Farm and the only thing she can offer me is some kind of bargain that the other side has to agree to. F*CK THAT... that old lady is 100% at fault and they even said that when they called the DMV Instructor he said that they were both at the stop sign at the same time, but when I called him he said they only called to see if he was injured or not. **$#&$(#@&$*@ friggin bastages the whole bunch of them are. Its already bad enough that they are dragging their feet through all of this, but making me pay a deductable for something that wasnt even my sisters fault? that is horsesh*t. They also said I cannot take them to court unless its a claims court. God all these people are all the same. They are out to take your money and screw you over. Anybody know a bit of law because I'm gonna sue the hell out of these fraudulent bastages...

Cliff Notes: State Farm drags feet through case (~1month so far)
Puts 50% of blame on my sister even tho the other lady is 100% at fault
Demands I pay a 250 dollar deductable to repair car
Same people handling my case as the old lady
Says I cannot get an arbitration against them or sue them
Need Some Legal Advice

are u going to get any points? im pretty sure you can appeal the decision. I had a accident about a year ago they decided it was my fault which probley was but I went to appeal it anyways. Met life rep didnt show up to court so I win by default.

Take them to claims court with a police report, only in the report can it proven that it was 50/50. Let the judge decide who was at fault and who gets the points and has to pay up not State Farm. Also consider this if you have a clean police report saying that it was the others fault and a witness then you are in the bag, but if your sister was doing anything wrong and it was filed in the report it can be filed as 50/50. I ran into a similar experience a few years ago where the police estimate was 50 in a 45 for me (based on skid marks) and failure to yield for the other person, it was obvious that they were at fault because they were charged with possesion of maijuana, driving while intoxicated, and failure to yield and I was just coasting down a hill and the car rolled to about 50 before I had to lock the brakes. Even though it pissed me off I thought it was the funniest wreck because I was in an '89 Accord and had a busted front right bumper and they were in a '98 Protege and the lost the front bumper, hood, one fender and headlights due to the angle they were at when they pulled in front of me.

go with allstate, thats who I have. I hydroplaned my car and they blamed it on poor road conditions. Althought my allstate agent is a really good guy.

well I just got off the phone again with State Farm and these people are giving me the run around. They are making up all sorts of crap saying that my sister could have made the turn into the wrong lane and yadda yadda yadda when its a 2 lane road... god these people are the shady people in the world they are making all this stuff up and now they want to send a person out to take pictures AGAIN. Im through with all thise run around crap because how can my sister have hit the friggin old lady if we got hit in the rear quarter panal HOW?!!!!

Ive had state farm and they have been nothing but great to me- it's most likely the agent screwing with you, not state farm itself... You need to get a look at the police report asap so you can see what was determined by the cops before you do anything else...

I was in a similar situation about 3 years ago -- i hired a lawyer because I know state farm will play games because the other party also had state farm -- they offered to settle - small amount -- the lawyer got me a total of $10,000 -- now this was an 86 celica which was worth like $1000 tops - maybe not even $1000. The lawyer got $1500 out of it and I got the rest.

If you strongly believe you are not at fault -- get a lawyer is my best advice -- you can get a whole lot more -- again this is personal experience dealing with state farm --

they are a good insurance company - but when its state farm vs. state farm - ur screwed

USAA owns all.

As for your situation, show them the police report stating who was at fault, and provided that's in your favor, if they INSIST of pressing the issue, contact a lawyer.

IF you do pay the $250 deductable, that's essentially an admission of being partly at fault. The deductible will be your part of the payment from YOUR collision coverage, and your insurance rates will go up. DO NOT do that.

sue them for pain and suffering - they have to pay it. also gives you levergae, becaus ethey will want to exit out of that because it can costs them thousands and they won't worry abut the 250 anymore
