while i was on my way home last night with my brother and my cousin, cruising to a stop then suddenly a car hit me on the driver side and then i realized that it was a police cruiser. he beat the red light continued driving 3 more blocks. called 911 and cops came in. thank God no one was hurt.

they told me that the cruiser was malfuntioning because of the gadgets hooked up in the car. the cruiser came from an alley, my cousin noticed it but i didnt because i didnt see any lights on including the siren. this happened around 9pm. the one driving the cruiser told the investigating officer that he was parked at the corner of the alley, he was applying his brakes then suddenly his car revved just like that and when the time that he hit my car, he said he put it in parking gear. I DONT KNOW IF ALL HE SAID WAS POSSIBLE!

i called my insurance and let them know what happened. the investigating officer told me that it was definitely not my fault and the insurance would take care of it.

i dont know what to do now...
im really pissed off!
seems like i would sue them!

any advice or help from you guys? thanks

Please don't get sue happy. wink.gif Just let insurance take care of it. The officer said that it wasn't your fault...and it wasn't , so just get the damage fixed. Maybe there are some goodies you may have wanted. hehe

tomorrow i will call the claims department and try if they could give me a rental car for now...

i'd sue the fcuk out of the police.

And if the car was in Park, thats not usually an electronic thing, it's a mechanical device. confused.gif Plus, even if it was an electrical problem, that means that the cops are not obeying the laws that they hold you to. Are you going to let a cop tell you its okay for him but not for you? He's saying he's better than you. I'd sue that mother-fcuken police station for all it's worth, and my tax dollars too!!

I have actually heard of this happening with the older police cruisers. I don't think you should sue them seeing as your insurance is going to pay for it all anyways. But thats just me.

What if the insurance marks his car is being totaled since its not driveable? Will they give him enough to buy another 6g?

If the insurance check isn't enough, then you go to the police and get the rest for a new 6gc. Same thing happened to my buddies pickup, except he got rear ended, cop got out car lurched forward and destroyed the back end of his new Tacoma.

last time my car got totalled out they low-balled me and was barely enough to cover half of the cost of my 2nd celica. and the way the law looks at it, is that since the insurance company paid out (at the cheapest possible expense) then everything is even steven. even if that means you have to heft the additional amount to replace the car, plates, registration etc etc. and forget about reimbursement on aftermarket parts, insurance companies essentially say they should not have even been on there to begin with even though they were damaged by the at fault driver. gotta love our legal system eh? rolleyes.gif

Insurance totals a vehicle by normally: If the estimated damages to the vehicle exceed 2/3rds the value of the vehicle (or some other % depending on who you have ect.) they total the car. You will get a check for the market value of your car, (normally not enough). You do however have the option to buy your car back from the insurance company (normally pretty fair price) and use the check they wrote you to fix your car and get a salvage title.

usually the check is not enough to just go out and buy a new car, no.

EDIT: Insurance company's do not cover aftermarket parts most the time...why you ask? because YOU DID NOT CLAIM THEM ON YOUR INSURANCE. If you claim parts and modifications on your insurance plan normally they will cover it, but you have to notify your ins. every time you do it ect. and your rates probably will go up (ie more $$ insurance)
Thus 99.9% of people do not claim upgrades on their insurance, so when you go boom they won't cover them because they cover what is supposed to be on the vehicle.

playr158, I dont know where your from, but around where i live the police are powerless to protect, but endowed to punish. "Failure to control motor vehicle" is an arrestable offense depending on the severity of the incident. Now how is it that a cop can "oops" his car down the street to total someone and walk away by saying "sorry" but i have been arrested for it? Fcuk that cop; and his car.

Yep, cops exercise their advantage of authority way too much. But what Dan said is pretty much how it works here in Canada.
Totally sucks, and good thing you're not hurt or anything but it's too bad your celi is gone. You'll probably get back like...3-4 (max) gz for it...then go out and buy yourself another celi.

your insurance should not pay a dime. Otherwise your rates are going up buddy. The city has to pay for your car. As this is definetily their fault.

If your insurance pays, you need to establish a lawsuit so that your insurance gets the money back, your rates dont go up, and you get paid for damages.

If it were me, thats what i did when another lady hit me in the rolla. I called my insurance, but let them know i did not want my insurance to pay. It was her fault, her insurance would pay. If not. then my insurance kicks in in addition to the lawsuit.

Guess what happened. I got a check in the mail from the other ladies insurance.. biggrin.gif You are just protecting you civil rights.

It does not matter if its a cop or not, its a city owned vehicle. therefore you are entired to sue the city, not just the police....

I personally don't think you should sure the department either. For one, it's paid for by tax dollars, so you're not just suing the police or the city, you're suing yourself. That's so lame. For another, they already accepted liability, in all likelihood they're gonna cut you a fat check so you DON'T sue them. Agree to nothing, give them a chance to make it right, and if they don't make right on it, then maybe contact an attorney and see what your options are. Or, contact an attorney now for advice on how to go about this in such a manner that you protect yourself while giving them the opportunity to make it right.

I think it's SUPER lame when everyone just assumes all cops are assholes or whatever. People spend so much time hating them or blaming them and what-not, but then if something ever happens, they're the first ones you call and rely on for help. If you have problems with authority, don't take it out on cops, go see a shrink and figure out why you're so pissed off at your father or mother or third grade teacher or whatever. The majority of cops really are there to protect and serve. Give them a chance to make it right. It's just the right thing to do.

I agree with GriffGirl. It really sucks that your pride-and-joy was hit but mistakes/malfunctions happen. I've been in the cops position before in a 6-Pak Chevy 3500 long bed government vehicle. The brakes went out (retard changed a caliper and didn't bleed the lines) and I slammed in to a car at 50MPH on an off ramp. I had about 10 drivers cussing at me and saying how they hate the government because I can just walk away from totalling 2 vehicles and get nothing from it...that their tax dollars were wasted down the drain...that I should have to pay for both vehicles plus emergency responders fees. That the guy I hit was without a car for weeks while the insurance got sorted out. I really felt bad for the guy but what was there for me to do. He was the only one on my side because he know the gov't was going to buy him a new car. I talked to him about a month later and he got a check well over KBB for his car.

Just sit tight and see what happens.

they said that the police claim department would take care of it, not my insurance. Mercury is just trying to help me out. if they low balled me, that would piss me off and might decide to sue them. now im trying get contact with the investigating officer to help me out in the claims department to get me a rental car.

nope, i wasnt speeding at all. well the investigating officer told me already that it was definitely no my fault. in fact the police cruiser is in the corner of an alley and he should yield to oncoming traffic. i bet he was there trying to catch someone who would beat the light but unfortunately didnt pay attention if there are oncoming cars. he's risking people's lives and property just for the sake of getting someone a ticket.

also i dont own a cellphone. my cousin was the one who has the phone.

well i m not against your opinion, this is a forum where people are free to criticize or give there opinion.

the cops were actually profesional when they talked to me. they seem nice a willing to help me out. well i just dont know the guy that hit me though.

guys, if this could be taken in diplomacy, it would be okay as long as they replace what is damaged. if it turns out that i will get what is not worth of the damage, ill try other options. suing is the last resort. it would take time for results to come. for now i would try to do as best for that not to happen.

Dude that sux. Hope everything works out for you in this deal. If they don't give you enough to cover EVERYTHING like it never happened, I say take it to court. City and the Dept. I'm just a lil miffed cuz the other day I got pulled over by a silver subaru that was kinda modded. Anyways, good luck with everything dude, and definitely make it so the city pays instead of your insurance cuz it would suck to have your insurance go up because of someone else's mistake.

nope, i wasnt speeding at all. well the investigating officer told me already that it was definitely no my fault. in fact the police cruiser is in the corner of an alley and he should yield to oncoming traffic. i bet he was there trying to catch someone who would beat the light but unfortunately didnt pay attention if there are oncoming cars. he's risking people's lives and property just for the sake of getting someone a ticket.

also i dont own a cellphone. my cousin was the one who has the phone.

being nice wont help any. insurance will try to low ball you. its their JOB to look out for themselves and teh best interest of the city. GET YOUR MONEY. youre not stealing, and no one is going to personally suffer financially or otherwise for you getting a little extra.

I learned my lessson about being nice guy in such situations. and now I may get sued because some people want to be greedy. like i said before, nobody in particular is coming out of pocket so do what you gotta do wink.gif

WHY does everyone automatically want to sue people. I'm so sick of frivolous lawsuits just because someone THINKS they should do something.

This is an insurance issue. The police already told you that it was not your fault and you called your insurance company. Wait until the insurance company assess the damages to your car and then gives you whatever they think you are entitled to to fix it.

To everyone who chimed in to "sue" please don't give advice if you don't know what you're talking about.

You sue someone if an amicable solution to a problem cannot be reached out of court. In this case there is no reason to sue inasmuch as you've already contacted your insurance company to pay for the damages to your car.

IF the police car hit you and then claimed it was your fault THEN you could sue.

Sorry if that came off harsh but i've been in the legal field for 4+ years now and no one seems to understand that suing someone is supposed to be the last resort not the first thing you do.

deff give them the chance to make it right, sueing them is in my opinion a waset of time your money, their budget and the citys tax dollers, also imo unjustified, they said it was not your fault so your issurance rates will not go up, it is not legal for them to raise your rates unless your at fault.

Its not up to your issurance to cover any of the cost, its the police departments issurance that will cover it, and probably cover it pretty well. get a rental right away or charge for bus/taxi whatever, and clame the real value of your car (extra parts included,) when my civic was totaled I clamed every aftermarket part (had to have recipts for it all which I did) and they paid for it all, I left out a few things that I was able to pull from the car with no issues, thus I got what I feel was the real value of the car. and got the check in 2 weeks including loss of wedges because i was out of work for a week, and due to my age (total bs imo) they were not able to get me a rental so my dad "rented" his extra car to me for a resonable cost which they covered.

Point is, give the system a chance to make it right, the nicer you are about it to them the happier they are to deal with you and do right by you. you get angree then they dont want to deal with you.

Has the thought occurred to you that there is such a thing as karma? Sure, it's no one's money in particular, it's just the taxpayer's money. Got a job? Then yeah, that's YOU, buddy. Maybe not in this case, but in plenty other cases just like it. Stop and think about what you're saying... I'm sorry you *may* get sued "because some people want to be greedy", but really, that eye for an eye **** stopped being relevant 2000 years ago. And retaliating vicariously through someone else's misfortune is kinda low.

Doesn't your insurance go up? Don't you have to pay a deductable? Don't you have to go a period without having your car? The way I see it, this land was built from crooks (look into our source of money, insurance, how we all live off of credit which goes back to who makes our money, politics, tax breaks for the rich, and the list goes on). Suing is just being a good American.

ACTUALLY miss griff yes karma has come to mind, but im not in that religion. wink.gif I always think before i speak, an eye for an eye is in full effect and i do pay taxes, and people are going to do it anyway. i havent felt the pinch in my wallet from fradulent claims yet. Karma told me that if youre mr nice guy, it will come back to you after people take advantage of you first. life is about GETTING YOURS. because nobody else is going to get it for you.

last month my wife was involved in a four car accidend with her curren ;( ... it was her, 2 other americans and a japanese van. she stopped, got rear ended by the van, which pushed her into the car in front of her, then another american smashed into the back of the van. in japan, if you are in a car wreck of any kind, there is a percentage that is automatically your fault if you are an american, because japanese law states that all americans are "professional drivers". well, come to find out, that van was owned by the local police department, and NOBODY but the PD's insurance paid a cent. the only damage caused by the wreck was the hood was bent up and the boot was bent in so much that it wouldn't close. they completely stripped and repainted the hood (which i was gonna do anyway, magnet melted to it), and fixed the rear bumper (which i punctured a hole in about a year ago).

my point is, if it is anything like it is here where you are, you should have no problem.
