So I find out late last night (while going out to get something from my trunk) that my car was towed (thought it was stolen until cops told me it was towed). F'ing security thought my car was not suppose to park there (recently changed hatch and spoilerless, so maybe thought it was another car).

Anyways, I cost me $250 bucks to get my car. What ticks me off is that the tow truck guy damaged my rear bumper (scratches) and also jimmy'd my car to get in to set the car into neutral. My tires look like they were dragged when the car set to park (tires deflated to ~20psi with "weird" marks).

I'm considering calling up my insurance company and filing a claim. Any one else experience this kind of thing? Is there steps we can do to prevent our cars from being unjustly towed (like turning the wheels a certain way, parking face out, etc)? Is it even legal for them to enter your car?

Talk to the landlord, or whoever is in charge of security. They are the ones responsible, if you were following all the parking rules. Good luck!

i would bitch out the towing company for damages, get several estimates, high and low end, then give it to the tow company (the high ones) and be a total dick to them.

and if you followed all the parking rules set forth by your landlord or whoever is incharge of parking, then id also go to town on them as well if they dont resolve the situation to make you happy.

I agree with Jason. The landlord/property mgmt company should pay for the tow, if they're the ones that had you towed. Around here, tow drivers cruise apt. lots looking for illegally parked cars, so it could be that the driver made the "executive" decision to tow you. This happens FREQUENTLY around here from what I hear, so much so that they've actually made laws about it.

If the landlord/prop mgr isn't in charge of this and says "they were just doing they're job and made a mistake" then the tow company should reimburse you. Further, you should submit your estimates to the tow company and have them pay for damages. If and when they refuse, contact your insurance company (assuming you have comprehensive and not just liability); they will very likely go to bat for you and get the tow company to pay up. Last resort, and one I'd pursue if I had to, is to contact a lawyer. And the news; get it on the local news, it'll really f with the tow company and they will very likely be more accommodating.

you'd fir in with my family/friends perfectly.

i completely agree. DO NOT file a claim with your insurance unless its a last resort.

take pictures of ALL the damage; tires, bumper, if the jimmy damaged picture that as well. make them pay for body work/pain, and a new pair of front tires.

Same thing happened to me. The sob ripped up my bumper. He is so lucky I was not home, because I would have stuffed the barrel of my AR down his throat.
The mainteance guy had my car towed. So I found out later. I went after his car a few months later. My motto is you f**k with my car, I'm going to mess with you. Don't get mad, get even! biggrin.gif

the worse thing you can do is let that slide. It sounds like you're trying to avoid conflict but you should definitely get something done about this. Assuming you were legally parked, you should not have to pay for anything. Gl anyhow I hope everything turns out ok

$250? for a simple tow? and a "mistake" at that? Get it ALL back. plus damages, from the people that had it towed and/or the tow company. Do NOT let them take your money, tow companies do that all the time, its their word against yours that you were/were not illegally parked, anyone that doesn't fight it is just free money for them.

Get a lawyer I believe the same thing happened to my friend he got reimbursed for all the money and time he spent dealing with them and in court. He went to the court room one time and his lawyer did the rest.
