Your hood for no reason (Or even in California)? I was hearing about things like this happening. Today I got pulled over because my license plate was falling off due to a screw missing, so I put it on my dashboard. I got pulled over for a fix it ticket (not a problem) and the cop asked me if I had any engine modifications. I told him "No", and he took my word for it (and believe me, I have no modifications other than that aluminum hood, not even an exhaust). I was curious why he didn't make me pop it anyways. Was it because had I said yes, he would be allowed to then check it?


I wear hearing that in Santa Barbara, because of illegal displays of "exhibition of speed" (Hah! I didn't say the R word), that any car for whatever reason, they just pull over and say "Pop your hood" and then cars get impounded. I am not saying it is okay to do the "exhibition of speed thing", but some of us cannot afford a Mercedes McLaren, and just want that luxury, ya know?


Anyways, what are your thoughts or facts?

Not to sound rude or anything but how old are you?


When I get pulled over because I am tat'd and pierced cops ask me... Are you under the influence of drugs or in possession of firearms...


If they are only askin you if you have mods you must be young...and/or I look like a drug crazed killer?


But,seriously, COPS ALWAYS ASK DUMB QUESTIONS to see if you will slip up.

I've been pulled over for loud music,loud exhaust,window tint,etc... They always do it just to effe with you and I've never had a ticket from any of those... I even had a cop say...wow...this is a celica? it looks way nicer than the one I used to drive in college..... ahha

im not sure about ca but in redneckville fl i get pulled over constently and im in LAW ENFORCEMENT and they still like to give any rice rocket crap. whether it be jdm or all riced out the cops dont really care out here they hear a buzz of a 4 banger and there lights come on. the only tickets i had recently was a dragging ticket in my mini but that was a year ago.

I am 26 and I look 18, plus I guess it didn't help I was wearing a bandanna. I drove around with my license plate on my dashboard for nearly two months, so that was expected. But I did drive in front of many of cops and they didn't look at me strange or anything. So I was just asking, because I do have many future plans for my car. I just wanted to know other than speeding and such, if they can just do it for no reason.

I heard that you are to ask (if you obviously did nothing wrong) to ask them what the problem is, because usually 9/10, they just want to see if you slip and give yourself up.

For the record, this is my first time ever being pulled over in my car and the cop was very nice. I was just asking hypothetically, can a cop make you pop the hood under any circumstance for engine/under the hood modification?

I guess some people can get away with it, but for our cars, nothing except exhaust and injen (or carb approved) intake from my knowledge.

from what ive heard they can due to the high restrictions on mods and stuff like that when i was visting my cousin in Pomona we where pulled over in his 240 and they made us pop his hood and cause hes a speed freak, he put a sr20 with big turbos on it which from the cop was illegal mod and wasnt considered street leagal so was towed. but cali is weird on there road safety laws. i was pulled over for whereing a hat and sandals got a dang ticket for it too i was like wtf this is gay

i don't think they can make you unless they take you into custody or have probable cause. otherwise that's like searching a house without a warrant. but i might be wrong.

That would make sense, but this is Cali we are talking about.
Everyone I have spoken too said that a cop can pretty much MAKE you open your hood. The probable cause in that case is that they think you are violating smog laws. Its pretty much Nazi Germany over there.

good point. but what if you aren't doing anything to warrant probable cause? no speeding, not extreme styling, mostly stock... would that warrant a "search" just on the fact you are a teen driving a japanese sporty car?
i will say this much. i'm damn glad i don't live in cali for that reason. can't do anything to the car without all sorts of hassle from the fuzz

From what i learned in democracy........

cops can "ask" you to pop your hood if:
-they have a really good cause
-got a tip from someone
-if they're part of this special units cracking down on street racing (only know of this in hawaii dont know about you guys)

-there are many loops hole in our laws and such.....i do know that some of your privacy rights are forfitted when in your car.

and some other things i cant think of

Well, I heard in some cities they can make you but I wish there was a way to know for sure. I almost asked the cop today, because I thought it was strange that he took my word for it and didn't make me pop the hood.


He was just like "Do you have engine modifications?" and I was like "No" and he was all "okay". He was real cool, so I was about to ask him but I was like "awe, never mind".


Of course if you were speeding or anything like that, yeah I can see them asking you to pop the hood. But this was my first time getting pulled over in this car, so I thought it was kind of strange he would ask and take my word for it without "forcing" me to pop it open.

New News... I heard a cop can "ASK" you to pop your hood, assuming there is no real reason of you committing a traffic violation and assuming it is because your car caught their eye. Now I am currently trying to discover from an attorney if in fact you can be forced to if you commit no serious traffic violation.

You can say no, but believe me, you'll regret it.

You don't "have" to let a cop do crap, but when it comes down to it, you "could" be drunk, and it's your word against his. So you'd get a dui and he'd have "reasonable cause" to search your car. frown.gif

But on the bright side, alot of police don't know the first thing about engine performance. They have to take a driving course, but otherwise, their cars are already built for them, and they don't have to do a thing to it. They're trained to look for nitrogen oxide bottles; but provided you have a heat shield over your turbo, i'm sure 2/3 they wouldn't recognize it. The ones that would, will do some B.S.ing with you for a bit, then send you on your way. Those are the law-men that enjoy the auto-racing sport, and as long as your not an idiot, (racing on the street rolleyes.gif ) they usualy dont care. In texas, you cannot get a ticket for havening a car that dosent meet emissions unless your sticker is out. And that's a ticket for the sticker, not for the car. (unless it's EXCESSIVE!!)

Thanks. It looks like I might be moving to Texas after I finish school then. Because loving cars in California is like holding out on women for Jessica Alba...... Just can't happen. I wonder what other states nearby allow you to be exempt from emissions. I know some counties in Nevada do that. I just wish and pray Vegas is in one of them (doubt it).

well i think in cali its diff cause of the emission laws, and i think they are trained on the types of engine that are being swaped in like sr20 swaps, but thats hear say you would just have to ask a cop you see around and strike up a convo for you guys in cali

honestly i think he might have just been a fan of cars and was wondering if u had much done to it. my friend got pulled over in his mustang jsut because the cop thought it looked great and wanted to ask him about it. I just talked to my sister who majored in criminal justice. she said that if they had suspision of you haveing something illegal under the hood than they can ask. u can refuse but they might take u to jail and take your whip. but i explained to her your scenario and she said that he was probably just fishin around tryin to find somethin to do to take up time

funny story about car search, my firends and i went to denny's at about 1 am on saturday and we got pulled over for cuting a cop off which wasnt true at all. anyway, if a cop asks if he can search your car u CAN say no adn that means they cant search your car. thats what most citiezens dont know. u can say know to teh cops search request. unless you are hgih or drunk they can. or of course a warrant. other than that tell em to piss off...in a ncie way haha

Yeah, back when i ran Cougars i used to get pulled over all the time (in my '85) because it was a Rip-Roaring beast of a car. (looked like a total sleeper) but i'd get pulled over and asked to see what it had, and never once got a ticket in it. Even when i deserved one (had a sticker out once, nothing crazy rolleyes.gif ) but it's classic look, and obvious "power over beauty" build got alot of attention.

Well, that and the fact that it looked like this:

But after seeing those pics, you can imagine the police wanted to know why on earth anyone would drive it. (they usualy understood when seeing the Super'd v8 5.0L) laugh.gif

But On topic, you need to check your local laws. Texas (luckily for me biggrin.gif ) has THE MOST lax and lenient laws in the country (driving wise). Mostly because every 4th car on the road is a dually-diesel, 2/3rds of the rest of the population are trucks or SUV's; half of witch are heavily modified and jacked up 4-6 ft high. now; this changes state to state, so i reccomend that you check your own states (and citys) driving laws, before making any kind of mod. wink.gif

EDIT: at the same time i also had a 2003 cougar; but i loved to run the 85! Such a sweet ride!! thumbsup.gif

Yes they can search your car, yes you can say no. But if you have nothing to hide whats does it matter?
you only create more trouble by making things difficult.

well my one friend whos car we were in is very sensitive about his stuff, he has everything perfect in his car, he has some OCD because he HAS to have everything in the same spot on not messed up. if someone messes it up he goes nuts. so he siad no i would not like you to search my car, the cop ahd a surprised look on his face and said alright

yeah, but you wont always get off that easily sever. It is a true fact, you dont have to let them search anything. BUT; if they say you're drunk or high or something, it's your word aginst theirs, and they can really jack you up. (believe me, we've got alot of police friends throughout my family, and these guys think its hallarious to do stuff like that to "punk kids") thumbsdown.gif So have respect and your more likey to get off. wink.gif

But i will admit sever, this is a true fact! you CAN tell them to piss off. (But just because you CAN do something, doesn't necessarily make it a good idea wink.gif )

By law, you have the right to refuse a search, and the officer can NOT search the inside of the car without probable cause.

Now if the officer sees an open beer bottle in your back seat, or gets a drug dog, who indicates drugs in the car, then that is the probable cause that lets him search the car. If he doesn't see/find any of those things, then he can not search your car without a search warrant.

However...California works a little differently. They still cant just search the inside of your car for no reason, but they can make you pop your hood. The probable cause in that case would be if the car looks modified from the outside. THIS LAW ONLY APPLIES TO CALIFORNIA. No other state will ask you to pop your hood.

Yes, what Lagos says is right. They can't just pull you over and try to search your car without probable cause. I would understand if they saw a gun or any kind of narcotics in the passenger or rear seat. But other than that, they can't right you up for a modified car. There is NO LAW IN AMERICA that states you cannot modify your vehicle. Unless it's a safety issue such as getting rid of your rear quarter windows which will cause a blind spot. Every vehicle part will need replacement parts after a while because they will go bad! Such as rusty leaky exhaust pipes. BUT what you cannot do is modify the volume output of your vehicles exhaust. Meaning that you can have a modified exhaust. It just can't be as loud as your stock exhaust system. Fortunately no one really takes records of the volume output on cars. But ofcourse, if they hear you a mile away, they have every right to ticket you. Besides that, they can't ticket you for anything that is modified. Ofcourse, they will try to f*ck with you and say misleaded statements such as, "You know, it's illegal to modify your exhaust right?" Or "You know it's illegal to modify a vehicle right?" Just so they can right you up for something.

FLORIDA STATUTE 316.293 (Subsection 5A-B) ?

(5) NOISE ABATEMENT EQUIPMENT MODIFICATIONS.--
(a) No person shall modify the exhaust system of a motor vehicle or any other noise-abatement device of a motor vehicle operated or to be operated upon the highways of this state in such a manner that the noise emitted by the motor vehicle is above that emitted by the vehicle as originally manufactured. (b) No person shall operate a motor vehicle upon the highways of the state with an exhaust system or noise-abatement device so modified.

The exhaust cannot be LOUDER THAN ORIGINALLY MANUFACTURED. However, the flaw with this is the fact that the policing agencies in FL rarely, if ever, have any sound testing equipment. NOR do they know what the stock DB level on your car is. Now, if you still have the cats, resonators and mufflers there isnt much ground for them to stand on. Also, there are flaws in the fact that your exhaust can be modified an still be quieter than a stock production car (SRT4 and Cobras come to mind but try not to use this argument)

Also, here are the DB limits for passenger cars (to be measured at 50ft)
.....................................under 35mph ...........over 35mph
Before January 1, 1979 ........76 dB A .................A82 dB A
On or after January 1, 1979 ....72 dB A ................79 dB A

wow as much as i hate fl i really like it after seeing the bs yall have to go through. I have no emmisions no inspection sticker an i usually ride around with 5% tint on my windows and never got stoped for it!!!

I don't get how your exhaust can't be loud for noise pollution, but the ice cream man can bump his jack in the box tracks while he cruises through your hood. That is loud too.

Alabama is really lenient with automobile laws. The only thing they look for here is excessive tint and even then they barely ever pull over and check they usually just give warnings. I did hear on the news the other day our new mayor is going to make the people with "22 wheels have to get a CDL license cause it's tearing up the roads. Yep a lot of rednecks with monster trucks around here, that and Monte Carlo's and what not with gigantic wheels. Other than that you are free to do whatever you want to your car.

well i live in south fla now i got about 3 modified exaust ticket each time the cop said it was loud but when i went to court the judge dismissed them each time..... i lived in nyc the only problem wit mods up there is to pass emmisions.... thats why i build the car down here then send it to nyc if u look most of the modded cars in the city has out of state plates.... good old fla no emmision....


the cops down here give u a hard time when u dont know your way around the law....
I wound not let them search my car but thats just me......

So if I register my car in another state, that is one way around driving a modified vehicle in California? Assuming I do not do illegal street activity? Because I think racing on the street is stupid.

Cops always ask people in videos "Why do you need a fast car if you are not speeding?" My answer? "Why does a person buy a corvette, or any sports car for that matter?" The answer is simple. We are enthusiasts who want that luxury.


But due to the dangers by those who do not care of other peoples safety on the streets, I can see why they crack down hard. It just sucks that now, there are more cops looking to look better and will take whatever they can get.

I am happy they catch crooks who have stolen cars, engines, etc... But I wish there was a way to make a deal with them, to purchase a certain sticker that ways "We are in agreement that if caught street racing (which the sticker is a way to say we love cars, but against the racing on the streets), we will pay double the fines" and pay more during tags just like other vehicles that put out more smog..... I dunno


This is driving me nuts. I am going to end up leaving California over this unless I find a way around it.

all i kno is over here, cops can ask u and you can say no. but by saying no, it just kinda means ur hiding sumthin.
normally cops aren't trained to spot illegal mods.. so if u refuse, they can just call the ministry of transportation to get some1 out there 2 check it. and that guy usually knows what 2 look for and then u'd pretty much hv 2 pop ur hood

I'm from FL...and well i have have pulled over for nosie from my exaust...i went to court and laughed cause i explained that its stock...and they let me go...but even at the little car meets when the cops come they never ask to see whats under anyones hood....but i get pulled over in my 77' vette all the time the and the cops alway ask to see whats under the hood....but thats just cause they wana see what they heard 2 blocks away...lol...

i live in california and have had my car searched and the hood popped twice for probable cause, once for no front plate and another time for pulling out of a parking garage and apparently having the loudest exhaust in la county. you can be sent to a smog ref if you have modified your exhaust or intake in anyway here in califonia and it actually happens frequently

The amount of time an officer will actually call the MTO is pretty few and far between. Usually most cops will pull you over on suspision of illegal mods...like nitrous, or improper exhaust. But unless they have a reason to belive you have these mods, they wont check. But depending on the law in your area, they cant legaly check under your hood unless they ask you 2 and you give consent. At the same time though, in ontario, if they call in the ministry of transportation officer, they have the legal right to do a full inspection on the spot and depending on how bad the car is/if there are any illegal mods can take the plates off the car right away.

So no a cop cant, but in ontario, an MTO officer can and will.

That was a very interesting story from Aflacattack. I might consider Oregon then. So far Oregon, Nevada, or Texas. I am not so sure about the east coast though. You must live somewhere way rural and outside of emissions, because we do have emissions here. And the zoning to require emissions is increasing all the time - I used to live way in BFE outside of Estacada, and at the time there was no emissions requirement but it's changed since then and there is now. I think the only exemption is farm vehicles any more.

Renegade: keep posts like that and you'll get banned faster than you get pulled over. Just a friendly heads up. Welcome to the site.

Back OT: I DID get pulled over in Northern Cali last week for my HIDs. The officer used the words "painfully bright" repeatedly, and then told us to drive safely and have my lights' adjustment checked when we got back to Portland.

only time i've been pulled over in the celica is when my brake lights were out.

I get followed a lot but only pulled over once and I'm glad they let me know I had the problem 'cause I wasnt aware of it.

I live just outside Eugene.... never had or heard of emissions testing here. My brother lives in Ptown and drives a 95(or 96) camaro with a 3in catback exhaust and has never had to go in for emissions or anything. And i dont think that thing is sound or emissions legal at all LOL! so what is the law on this emissions stuff?

From what I've read, been told by Officers, and learned in school, a Police Officer can ask you to pop your hood if he has PROBABLE CAUSE. So, with that being said, if you are driving around like a maniac and get stopped, you may be asked to pop your hood.
