Well I didn't realize it but, I was speeding 65 mph in a 50 on the highway, how can the speed limit be 50 mph on a highway? Anyways, is there a way to pay the ticket but not get it on your record (for car insurance puposes). I'm trying to figure out some pleading strategies that will work when I see the Judge next month. I already got one, I almost got in an accident with a big rig after it swerved into my lane to make it onto the off ramp, so I was shaken up (think thats good enough to get the ticket knocked down a bit).

Advice please.

Prayer for Judgement.

it will mean you plead guilty to a lesser charge and not go on your insurace, however, if you get another ticket within 3 years, it comes back and counts!

i did it once and it worked great

so how do I do it, if the cop isnt there plead not guilty? and if he is plead guilty but, beg for a lesser charge due to mitigating circumstances?

i know exactly where you got that ticket
on 66 where construction starts right?

but dude just go to DMV and get your driving record
printed out, where a nice suit and show up on time

find your officer and see if he's willing to workout a lower charge or you can just go into the court room plead
NO LO CONTENDO say it like its written then show the judge that this is your first ticket and you have a clean record...he'll decided from there..

haha good thing i have your celica and you didnt get caught in it

If it's your first ticket let the DA know because they won't, chances are you might be going to Admin so the cop doesn't have to be there, never volunteer information and dress nice, also don't waste your money on a lawyer, the DA will probably automatically reduce your speed before you say anything, if you're not happy with it then speak. Ask most of the people that were in the cops suck thread I have enough tickets for a lifetime and seem to get out of a lot of them.

you know that the cop only shows if you request it when you mail the ticket in, if you dont then they dont have to show up. and dont lie like that, even if its true the judge will see though it. you need to say that you dont think you where going that fast, say that "I surtonly dont doubt the officer read the metter right however I'm very surton I was not going that fast, then bring up some facts about the road conditions and stuff like it it was wet or a dark road or a a buasy road, and what not to show that you remember the incedent clearly, and that you where not in a position where speeding was an option, high traffic is the best, plus mention that its posible the reading was of a differant car or was altered by distance or whatever. (never say the officer was rong or that he was at faut, always accept that the officer at least though he got a right reading saying he was in the rong will only get you in more turbble unless you can back up that he was, say if he was hidding or something, then back it up by a good description of the situation.)

remember the more prepared you are the better you look to be inocent, it shows that you did your homework witch means you belive yourself to be truly inocent witch is what really matters.

tip: do you best to offer all posible resons why you could have been speeding and dis prove all of them,

for example when i whent in for my no headlights in hours of nghtime ticket i said that the officer could have felt that wile it was past sunrise (legaly I was in the clear) that the weither could have affected the light, so I brought in the seattle times newspaper to show that it was a clear sunny day. witch was my winning argument I think.

hey..
kinda of funny you brought this up as im going to see the judge on may 5th for a speeding ticket..

i was going 94 on a 55...
i got away with just a 385 dollar ticket considering how fast i was going..

but my advice.. when u go to court... do dress nice, and on time...
and when its your turn to go up (from past experences, there will be a lot of people waiting to see the judge)... just act yourself...

dont try to say something that will make you look like your full of crap..

i remember i went to a judge once, and some guy made up some stupid story that hi speedometer was broken and he didnt know he was going 112 MPH, on a bike.

be polite, and say 'yes, your honor' after she tells you something or you tell her something..

since this is your first offence... the judge will probally give you the option of going to traffic school, if not, request it.. something like 'i would also like to know ifi would be eligible for traffic school, your honor'.. traffic school will take your points of your driving record... and the insurance company only looks at your driving record... so youll be good with insurance...

keep in mind tho... your records will show that you got a ticket. for up to 5 years (in CA anyways) .. not your driving record... just your record.. and insurance companies wont look at that...

also.. if you cant afford the whole ticket at once... also ask the judge if you can pay the fine in installments... most of the time the judge will give you a price to pay per month... if you still cant pay it... tell her that you cant... explain why....and request a lower installment for a longer term..

if youre polite... then most of the time they will give it to you...

well thats all i can think of right now...
i hope this helps a lil... by the way.. im an MP.. so i know a lil bout the system (not a whole lot.. but enough) smile.gif... that got cought speeding in the celi frown.gif

well good luck with the ticket...
and dont stress bout it... youll be fine...

wow you people outside of VA are wack we have different laws here
the OFFICER MUST show up for your trail to be held in VA

you never ever give an intention that the cop was wrong esp. if you live were coustoe and i live

oh and kirk......speaking of driving school.. GO BEFORE court
it will help out a good amount with the judge normally that shows you care enough and want to improve

so go get
1) DMV record
2) go take a driving class (i can tell you the info)
3) dress nice
4) yes your honor....no your honor
5) don't talk if you don't have to aka NO STORIES NO DISCRIPTIONS NO NOTHING
just answer as briefly as you can and make it short no excess

District is criminal court, if you get a reckless or other larger offence, Admin is basically for seat belt tickets and low speeding tickets. In NC anything 15mph or over is reckless so it goes to district, but it's up to the officer. In NC the course is 4 days, 9 hours a day.

Try this (I hear it used to work). When you pay your fine, write the check for 1 dollar over the amount (mail it in). The state will then cut you a check for 1.00 and mail it back. I hear that if you never cash the check, the file never closes and the points don't get added until all the financial transactions are complete. Good luck!

I've goten 2 tickets in my celica:

1. Competition for speed: Street racing down mainstreet.
2. Operating a moter vechile in a maner not proper: Peeling out of a parkinglot.

Neither one of these are on my record, here in Oklahoma you can ask to have your ticket "Deferd" which basicly means you pay an extra 50$ ontop of the ticket free and if you don't get in trouble for 30 days, it never gose on your record.

here in atlanta **** the cops be going 85 on a 55 and u just follow them or keep up atleast on 285 **** i go 90 all the way home and i never get a ticket. another key to not getting caught which might sound stupid but always look around ur mirrors when u are coming on a bridge merging on the road slow down a little then when u see there is no cop ur googd to go. then again there is so much traffic in atlanta if they is one staking out everyone puts on there brakes so. good luck

I love this forum!! its such a good thing you guys are around! you would think that after like 11 tickets and a suspended lisence and SO MUCH MOOLAH spent i would just try to get the case dropped if the cop wasnt there. it never really occured to me that I could do that! I had a court date on friday the 22nd in monroe NC, but i accidentally went to the one in sailsbury (i had a court date there for the 29th) I paid 110 in sailsbury for a 86 in a 60 got it lowered to a 74 in 60 and i may need to try to get it dropped in monroe since i missed the cort date. when i get it continued again maybe i'll do some fast talking eh? (even though dark secret says the cop that gave me the ticket is an arsehole. he also said that the guy be guesstimating speeds....hmmmm. biggrin.gif

pay the extra $50 bucks or so.. sit through a traffic school class.. 8 hrs on saturday.. you watch goofy and some other lame videos and talk about how stupid people can be.. and listen to some of the stories of how people ran into buses etc... and why they are there... funny ****.. just a waste of 8 hrs..

but point doesn't go on your record and insurance stays the same.. and you can take the class again in 18 months...

that's what i've had to do..

Go to the clerk of courts office and tell them you missed your court date due to your job at the middle school, they should just reschedule a new date. I go almost a full year before going to court by doing that but I tell them Rhonda Miller (magistrate) told me I could.

In North Carolina the officer only goes to District Court cases were there is a judge, they normally sit in the front and are called up when the defendant is the one they ticketed. If the officer is fired, quit, or transferred it gets annouced then you plead innocent and get sent home.

ok check it out, THIS IS THE EASIEST WAY TO GET OUT OF A TICKET, simply call a traffic lawyer (i have mine on speed dial on my phone) usually it costs about $50, you pay him, he takes it to court, it always gets dismissed with no points on your license, unless your doing something extremly retarded (suchs as me, 123 in a 65 zone(yes in my stock celica)) anywho, find a lawyer, pay him the $$$ and your good to go. Oh ya, btw, you dont even have to show up, gg.

bowdown.gif Who are you, the speeding ticket expert? This worked for my friend in California a few years ago (still no points). They've probably fixed it so that doesn't happen anymore, but for a one dollar investment, I'd try it out.

I'd just pay a lawyer to get it reduced to a non-moving violation - no points, its usually much cheaper in the long run because your insurance company will check your record on a regular basis, Last couple I've gotten have been around 200-300 total to make disappear. seems to be standard procedure around here to plead guilty to non-moving offense like defective horn and pay double the fine. dont even have to go to court. Called the lawyer and its something like "mail me the ticket and a check for 250 and its a done deal."

Try this (I hear it used to work). When you pay your fine, write the check for 1 dollar over the amount (mail it in). The state will then cut you a check for 1.00 and mail it back. I hear that if you never cash the check, the file never closes and the points don't get added until all the financial transactions are complete. Good luck!

^^ that is the biggest load of **** i ever heard

who the hell told you such B.S.

OMG thats OMG thats freakin retarded i need to leave this forum now

bowdown.gif Who are you, the speeding ticket expert? This worked for my friend in California a few years ago (still no points). They've probably fixed it so that doesn't happen anymore, but for a one dollar investment, I'd try it out.

Dont laugh, I had a lawyer tell me about one town around here where you asked for a continuance or 2, then went back and changed your plea to guilty and paid the fine, and the records would fall out of their system and never get sent to the state...

I personally am not going to take the chance...just have a lawyer get it reduced to a non-moving violation and pay a heavier fine. still cheaper than the higher insurance rates.

And dont get me started on insurance companies, My last few renewal notices have had some disclaimer about how my rates could be affected by negative information on my credit report. Only thing on my credit report was I had mailed 1 house payment late 2 years before (simply forgot). Been with those A**holes for 30 years and they want to raise my rates because of something that has nothing to do with them. I'm shopping around more next time...

I wish the NC court system would drop a case because of time, I go for a long time without having a case and they still hit me with a fine and court cost.

umm if its your first ticket shouldnt you be able to take a defensive driving class so it doesnt show up. you have to pay a little extra. I know for a fact you can do that in Illinois.. is it not like that everywhere?

Iv taken it twice now 1) for the first speeding ticket i ever got and 2) i made a plea with the state that i would take the class and be on 6 month court supervision so that they couldnt take my license away (it was my third ticket in a year)

Pay your fine, take an online driver's course to remove points, and don't speed again. Simple as that.

I fully agree with playr158, even NC law is different than and we're right below them.

Ask Andason he seems to think that his 3 years of criminal justice makes him a friggin lawyer, lol.

hmm here in cali...i believe you can take traffic school to clear speeding tickets, its valid for up to 3 tickets a time & doesn't add points to your record so no increase in insurance. Only thing is you can only clear it once a year or 3 years (forgot).

(even though dark secret says the cop that gave me the ticket is an arsehole. he also said that the guy be guesstimating speeds....hmmmm. biggrin.gif

Go to the clerk of courts office and tell them you missed your court date due to your job at the middle school, they should just reschedule a new date. I go almost a full year before going to court by doing that but I tell them Rhonda Miller (magistrate) told me I could.

Yeah, im going to do that today, get another continuance. what was that cop's name? young bald guy u were telling me about? if he dosent show i can plead innocent and get "sent home" as u said? COOL!! (by the way...what happened to veronica?) and we havent hung out in a while!

Officer Sherwood, Monroe Police Department, 3 years Service and still a rookie.

Oh yeah... Veronica... she's mad at me because Brandi found out about Sherry and Rebecca and Ashley, man it's been some drama. Brandi is still cool with me but 'ron is pissed, also the store has been busy and i've been working my ass off.
