i might be getting rid of my car but want some advice from someone that knows. in florida, you have to have bought the car new (check), be within 24 months of the delivery date (check, so far im at 20-21 months), and have taken the car to get serviced for the same thing (so far ive had my manifold replaced twice due to faulty catalytic) three times OR had the car in service for 15 days or more in the 24 months (i'm waaay past the 15 days, which is good). so i'm thinking of getting a full refund, plus collateral and incidental charges (financing costs, dealer options, labor, etc).

i'm just sick of always having to take it to the dealer for something. manifold, replaced supercharger, pulley/belt issues, etc. honestly, most service issues come from the supercharger. i have 18k miles and i had the manifold replaced at 8k and again now at 18k. the supercharger was replaced completely for a blown bearing.

my question is - since i bought/installed the TRD supercharger through the toyota dealer, would all these service issues and being without a car for 15+ days still apply? when i blew the manifold the first time, they were giving me the run around saying they couldnt give me a rental because the manifold blew because it was defective and NOT caused by the supercharger so TRD wouldnt have to pay for my rental. now this can work to my advantage, i just dont have documentation. but anyway, do you guys think i'll be able to go through lemon law to get my money back? its only been 18k miles, i still have another 42k warranty but its not even worth having to figure out rides for the rest of my life because i have to replace the manifold every 10k miles or whatever else comes up.

any thoughts?

edit: by documentation, i meant for the fact that the manifold blowing was due to defect and not the s/c. i have most repair orders and will be getting the rest today.

Since TRD upgrades are covered under the warranty when installed by a Toyota dealer I think this law would still apply. From what I understand TRD is now owned by Toyota [used to be a seperate entity] so that should further back up your claim. I'd get with a lawyer for a free consultation and get him/her to look at the existing laws and how they apply with your fairly unique situation.
Not sure I'd give up on it like that but if that's what you want - then that's the route I'd follow.

thanks DEATH. i probably will see an attorney. honestly, i love this car and scion has nothing but good customer service. my problem is mainly with TRD (USA). Nothing against technocraft/trdjapan or their products. i've actually talked to a few of the guys over there and they're very helpful - not sure if it's a culture thing because everyone i've talked to in japan is super nice. lol.

i just want to know why this keeps happening. the obvious to me is that the car is running very rich because of TRDs ECU reflash tune. and that's fine, i understand they'd rather have the car run rich than lean for warranty purposes. but damn, twice in 10k miles (the first time was just a few miles from getting the s/c)? if this is the case, i'd just like them to give me an honest answer and solution rather than accusing me of using cheap gas, not checking my oil, when my car is clearly taken care of (oil is checked once a week, been using premium since a week before s/c was installed, wash my car like twice a week. lol.) i dunno, i got offended the first time they told me, oh they think youre using regular gas and we need to do a fuel analysis. gimme a break! then i offered to bring all my fuel receipts and then they said "o, maybe you're using a fuel additive so they still need to check it out". just tired of all the run-arounds.

maybe the is350 would treat me better. im so tempted for that isf but i'd be pushing my budget slightly. still not sure what im going to do. def will consult with an attorney specializing in lemon law cases and see what my options are. thanks for the reply.

it's a TRD electic supercharger i got from ebay japan. laugh.gif pushing 2psi. jk. sometimes i have thoughts of getting a celi again and 3s'ing it, but i dunno - so many cars *sigh*

yea, im not completely dead set on the IS yet but it's tempting. i know eventually i'll want a 4 door so it wouldnt be a bad idea. leasing the 335 would be a good idea considering my uncle works at one of the dealers and i can get the employee lease offer which is very attractive, but i'm looking to finance. possibly just buy straight up cash if i get what i should from the lemon. was the lemon thing a big hassle to go through or is it a smooth process? it seems pretty smooth, but then again, someone new to car insurance would think so too. lol..

damn, i kinda figured. i may just do it though. still talking to attorneys. fortunately i have good documentation for all sorts of issues.

one thing i was originally concerned about was whether or not i had the option to choose a full refund or replacement car. im going for a refund and an attorney i spoke to confirmed i can choose. not sure if this is the same nationwide.

what were they bothering about the most?

i had a lot of miles on my car and they kept denying excessive oil consumption...this may take awhile but stand your ground and let your lawyer do your work.

i dont know about FL but in CA we dont pay the lawyer the manufacturer has to pay for all fees
